Terms of Use
This user agreement governs the terms and conditions of the services provided by Longeva LLC (hereinafter referred to as "Longeva"). It also includes the usage rules of the website, mobile applications, and all digital platforms.

1. Introduction and Scope
1.1 Acceptance of Terms
It is accepted that the User agrees to comply with this Agreement when creating a Service Request or Professional Profile via the Digital Platform or from the moment they start using the Digital Platform. If the conditions are not suitable for you, please do not use the Digital Platform and the services offered.
1.2 Right to Modify
Longeva has the right to unilaterally change or amend the Agreement to ensure the continuity of intermediary services, to meet future technical requirements, or to comply with legislation, provided that it is not against the Users.
Important Notice
By using the Longeva platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, you must discontinue use of the platform immediately.
2. Basic Definitions
Within this Agreement text, the following terms shall have the meanings set forth below:
3. Service Models
3.1 Offer Model
The model where, after the Service Recipient creates a service request, this request is directed to Service Providers, and Service Providers make Offers to the Service Recipient at their own initiative.
3.2 Reservation Model
The model where the Service Recipient determines the day and time for the service they will request one-time or regularly when creating the Service Request, and the Service Provider is directed by Longeva.
3.3 Regular Service
The model formed by the automatic renewal of the Service according to the frequency chosen by the Service Recipient in the Reservation Model, such as weekly or bi-weekly options.
Service Model Selection
Users can choose the most appropriate service model based on their needs. Each model offers different levels of flexibility and control over the service delivery process.
4. Fee and Payment System
4.1 Offer Fee
The service fee that the Service Provider will pay to Longeva in order to gain the right to make an Offer to the Service Recipient in the Offer Model.
4.2 Commission Fee
The fee that Longeva is entitled to at the rate determined by Longeva over the Agreed Offer for Agreed Jobs in the Offer Model.
4.3 Fixed Price
The standard unit fee previously announced for the service via the Digital Platform in the Reservation Model, to be paid by the Service Recipient to the Service Provider via the Online Payment System.
4.4 Balance
The fee defined in the Longeva account so that the Service Provider can make Offers to Service Requests directed to them.
5. Online Payment System
5.1 Reservation Model Payments
In the Reservation Model, the system enables the collection of the fee related to the service that the Service Recipient will receive via the Digital Platform by Longeva or payment institutions that Longeva cooperates with, using credit card, debit card, and other payment methods.
5.2 Offer Model Payments
In the Offer Model, the system enables the collection of the Offer Fee and Commission Fees that the Service Provider is obliged to pay to Longeva.
Payment Security
All payment transactions are processed through secure, encrypted channels. Longeva partners with trusted payment processors to ensure the safety and security of your financial information.
6. Services Provided by Longeva
6.1 Platform Services
Longeva ensures that the service, product, or service request information created by the Service Provider and Service Recipient themselves is included in the Digital Platform in accordance with the content notified to it and within the framework of the provisions of this Agreement.
6.2 Intermediary Role
Longeva is only a platform; it is not the owner or provider of the services included in the Digital Platform. Longeva acts as an intermediary service provider, facilitating connections between Service Providers and Service Recipients.
Important Disclaimer
Longeva does not guarantee the quality, safety, legality, or any other aspect of the services offered by Service Providers. Users are responsible for conducting their own due diligence before engaging with any Service Provider.
7. User Obligations
Users of the Longeva platform agree to the following obligations:
7.1 Legal Use
Users commit to using the Digital Platform for legal purposes only and in compliance with all applicable laws and regulations.
7.2 Accurate Information
Users are obliged to provide accurate, current, and complete information when registering and using the platform.
7.3 Platform Security
Users will not engage in actions that would endanger the security, integrity, or availability of the Digital Platform, including but not limited to:
- Attempting to gain unauthorized access to any systems or data
- Introducing malware, viruses, or other harmful code
- Engaging in denial of service attacks or similar disruptive activities
- Circumventing security measures or authentication systems
7.4 Intellectual Property
Users will respect copyright, trademark, and other intellectual property rights of Longeva and third parties.
7.5 Prohibited Activities
Users shall not:
- Use the platform for fraudulent or deceptive purposes
- Harass, abuse, or harm other users
- Post or transmit content that is illegal, offensive, or inappropriate
- Attempt to collect personal information of other users without consent
- Use automated systems or bots without prior authorization
8. Limitation of Liability
8.1 Content Accuracy
Longeva does not guarantee the accuracy, timeliness, completeness, or reliability of the content on the Digital Platform. Users access and use the platform at their own risk.
8.2 User Disputes
Longeva is not responsible for disputes arising from transactions between users. Any disputes between Service Providers and Service Recipients should be resolved directly between the parties involved.
8.3 Technical Issues
Longeva cannot be held responsible for damages arising from technical failures, system outages, data loss, or other technical issues beyond its reasonable control.
8.4 User Responsibility
Users assume all responsibility for their own actions on the platform, including any consequences resulting from the information they provide or services they offer or receive.
Liability Cap
To the maximum extent permitted by applicable law, Longeva's total liability for any claims arising from or related to these Terms or the use of the platform shall not exceed the amount paid by the user to Longeva in the twelve (12) months preceding the claim.
9. Agreement Changes
9.1 Publication of Changes
Longeva will publish the current terms of use on the Digital Platform under the same link with a new date update in case of any change to these Terms.
9.2 User Notification
If deemed necessary, users will be notified via electronic mail or mobile notification and submitted for their approval regarding significant changes to these Terms.
9.3 Effective Date
The renewed current Agreement will be valid from the moment it is published on the Digital Platform. Continued use of the platform after the publication of changes constitutes acceptance of the modified Terms.
10. Final Provisions
10.1 Governing Law
This Agreement is subject to the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
10.2 Jurisdiction
Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Delaware, United States.
10.3 Severability
The invalidity or unenforceability of any provision of this Agreement does not affect the validity or enforceability of other provisions. Invalid provisions shall be replaced with valid provisions that most closely reflect the original intent.
10.4 Entire Agreement
This Agreement represents the complete agreement between the parties regarding the subject matter herein and supersedes all prior agreements, representations, and understandings.
10.5 Waiver
The failure of Longeva to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
10.6 Assignment
Users may not assign or transfer their rights or obligations under this Agreement without the prior written consent of Longeva. Longeva may assign its rights and obligations without restriction.
